DSS Demands Withdrawal Of Suit Against Biafra Radio Director, Kanu

The Department of State Services (DSS) has requested a Senior Magistrates Court in Wuse Zone 2 Abuja, to stop the hearing of alleged criminal conspiracy against the Director of Radio Biafra, Nnamdi Kanu.
The Prosecution Counsel, Mr. Moses Idakwo, hinged his request on jurisdiction, as it has been discovered that the accused had been caught in acts of terrorism, including funding.
Idakwo stated that the application to discontinue the suit was in pursuant of section 108(1) of administration of criminal justice act 2015. He added that the DSS had in addition obtained an order from the Federal High Court, Abuja, on November 10, to detain the accused in its custody for 90 days.
However, the accused Counsel, Vincent Obetta, countered the withdrawal application, contending that the prosecution did not present any information from the Attorney-General of Federation who had the prerogative to approve the request.
Obetta contended that the DSS earlier violated the order of the court, which granted bail which was perfected but not granted, noting that the defendant has been detained since he was arrested.
In his ruling, the magistrate, Mr. Usman Shuaibu, adjourned the next hearing and ruling on the matter to December 1, 2015.
Kanu is being accused and standing trial on three-count charge of criminal conspiracy, including: intimidation and belonging to unlawful society. He had since pleaded not guilty of the charges.
