Fresh facts have emerged about the multiple infractions committed by the
embattled Managing Director of the crisis ridden Niger Delta Development
Commission (NDDC).
Sources close to the investigation committee set up by President Jonathan and
headed by former Head of Service of Nigeria, Mr. Steve Orasanya revealed that
the Mr Ugwoha forged a board resolution in other to open an offshore account
allegedly for pecuniary benefits.
Since the committee submitted their reports last week, Mr. Ugwuoha has been
running from pillar to post allegedly disbursing millions of naira in Abuja in order to
block his imminent sack. Instead, he is canvassing the dissolution of the board.
It was revealed that, in contravention with the NDDC act, the MD commissioned
Messrs Pearl Consultants and approved a payment N4, 451,452,275 to them
while acknowledging a letter from the consultant claiming a fee of 27 Billion naira.
According to the NDDC Act, the Managing Director cannot award any contract
exceeding 250 million naira. Contracts exceeding one billion can only be awarded
after obtaining a certificate of no objection from the Bureau of Public Procurement.
The process of engagement of Messers Pearl Consultants contravenes the Public
Procurement Act 2007 section 16(1). The members of the Committee were
reportedly infuriated by the shady details of the one of the top members from the
Ijaw ethnic group (names withheld) was said to have shed tears during one of the
closed door sessions with the management of NDDC.
Another revelation from the committee report indicates that the Managing Director
awarded several contracts amounting to over 100 Billion naira without any
budgetary provision.
These contracts were said to have been awarded without any reference to the
tender’s board thereby contravening the relevant provisions of the Public
Procurement Act: where it is clearly stated that contracts awarded without
budgetary provisions are null and void.
The report further reveals that the Managing Director relies on some powerful
officers in the supervising unit in the Presidency to perpetuate these illegalities.
